1. When to use it
Determine whether the model, management activity and client engagement fall within applicable New York law. Residence alone is not the test. Review any registration and client duties before the engagement proceeds. This template does not waive statutory, union or other non-waivable protections.
2. Required engagement schedule
Before creating or using the replica, record the model's name, the client and responsible management entity; the proposed creation and uses; the purpose and permitted channels; the relevant assets and transformations; the pay rate and payment arrangements; and the duration. Identify likeness and voice rights separately. The completed description must be sufficiently specific for the model to understand the proposed use.
3. Separate permission
Obtain clear, conspicuous, prior written consent from the model for the creation or use described in that schedule, separately from the representation agreement. Supply a copy to the model. A power of attorney, an agency upload or a general API entitlement is not a substitute. Materially different uses need fresh consent before proceeding.
4. Controls and records
Carry the agreed restrictions into generation, approval and release controls. Retain the signed consent, scope, payment evidence and applicable agreement version. If a necessary approval or statutory requirement is unresolved, pause the affected use rather than treat a blank field as permission.
