Washington Consumer Health Data Privacy Policy

Version 5.3, 22 October 2026. Effective 9 November 2026. Published at mirai.inc/legal/washington-health-data, linked from our home page.

v5.3 change note: no affiliate named; one signature rule for every channel; the face-check services described (R17).

This policy is from Mirai Talent Inc. ("Mirai", "we"), under Washington's My Health My Data Act. It applies to you if you live in Washington, or if your consumer health data is collected in Washington.

Mirai is not a health service. But the Act counts face images and voice recordings from which an identifying template can be made as biometric data, which is consumer health data. So your kit, your face data and images of you may be consumer health data. We treat them that way.

Washington at launch: no own face yet, then Create only

At launch, US persons cannot sign the Likeness Licence or add their own face under it (Terms §1.4B), so Washington residents create with Mirai's free faces, or with no person. When own faces open for US persons, Washington is Create only:

  • You can add your face to make content of yourself.
  • There is no Licensed Model path and no commercial licensing. We do not sell your consumer health data.
  • Content of you stays private to you unless you tap the separate confirm, "Share my content with others: gallery, cameos and partners".
  • You are never in an AI training set or dataset. No partner holds your adapter. Your face data stays on systems Mirai controls.

What we collect, and how we use it

CategoryWhat it isHow we use it
Your kitSelfie, head-turn and photos, and your voice if you add itTo make your Private Likeness Model and content of you; to check the face in your kit is yours
Face dataFace templates, embeddings, adapters, character sheet and likeness scoresTo make content of you and check it looks like you
Images and video of youContent of you made on Mirai, including cameosTo show it to you and, only if you confirmed sharing, to others

We collect these only with your face-data consent on the signing screen, and only for these uses. We ask for your consent again before collecting a new category or using it for a new purpose. Our Biometric Data Policy gives the retention and deletion schedule.

Where it comes from

  • From you: the kit you record after signing, and photos you upload of yourself.
  • Made by us from your kit: face data, likeness scores, and content of you.
  • From other users: a cameo with you, after you approve it; and personal creations with you, if you turn on "Friends and others can create with me".

We get no consumer health data from our identity-verification partner, a Partner App, data brokers or anyone else.

What we share, and with whom

We share images and video of you only after your separate share confirm, and only with:

  • other Mirai users and the public, through the gallery, your profile and competitions;
  • people in a cameo with you, after you approve that cameo;
  • Platform Partners (other apps that show Mirai content), never with your kit or face data;
  • police, courts and child-safety bodies, where the law requires; and
  • a company that takes over running Mirai, only as Privacy Notice section 12 says, after notice and a chance to Stop.

We never share your kit or face data with anyone except our processors.

Affiliates: none. If we ever add a Mirai affiliate (Terms §1.3), it never receives face data or data about US persons.

Processors handle data only for us, under contract: cloud hosting and storage; a cloud face-comparison service and an AI vision model for the required face checks; generation engines and their hosts, which receive kit references for each job and may not train on them; and safety vendors. The named list is at mirai.inc/legal/recipients.

If we ever sell

We do not sell today. If we switch on commercial licensing for Washington residents, every licence of content of you will wait for your approval card naming the buyer, the use, the rate and the duration. That card is your signed authorisation to sell. It is separate from every other consent and is never a condition of using Mirai. It states what is sold, to whom, why, and that the buyer may share it further outside this policy's protection. It expires one year after you sign it, and you can revoke it for later sales at any time. You get a copy, and we keep it for 6 years.

Your rights

  • Confirm and access. Ask whether we collect, share or sell your consumer health data, and get a copy, with a list of every third party and affiliate we shared it with or sold it to, and how to contact them.
  • Withdraw consent. Turn off sharing, or withdraw your face-data consent, in Settings with one tap. Withdrawing face-data consent works as a Stop, and "Also withdraw existing content" takes content of you down from others' view within 14 days.
  • Delete. Ask us to delete your kit, face data, content showing you and your account data. We delete them within 30 days, including backups, and tell our processors and everyone we shared them with to delete them too.
  • No penalty. We never treat you worse for using these rights.

How to ask. In Settings, then Privacy, or by email to legal@mirai.inc. You do not need to create an account. We check it is you by your signature (Terms §0.1A), by the email on your account, or by email if you have no account. Requests are free, twice a year. We answer within 45 days. If we need more time, we tell you why within those 45 days and take at most 45 more.

Appeal. If we refuse a request, reply to our answer or email legal@mirai.inc with "Appeal", within 6 months. A person reviews it and answers in writing within 45 days, with reasons. If we still refuse, you can complain to the Washington State Attorney General at atg.wa.gov/file-complaint.

How we protect it

Only the Mirai staff and processors who need it to run the service can reach it, with logged access. It is encrypted in transit and at rest and stored apart from other data.
