Our designated agent

Send copyright notices and counter-notices to:

  • Name: [to be added]
  • Address: [to be added]
  • Phone: [to be added]
  • Email: [to be added]

This agent is registered with the US Copyright Office: [to be added].

Your notice must be in writing and include:

  1. Your physical or electronic signature (a typed full name is fine), as the owner or someone authorised to act for the owner.
  2. The copyrighted work you say is infringed. If there are several, a representative list.
  3. The material you say infringes, and enough to find it on Mirai, such as a link or a licence ID.
  4. Your name, postal address, phone number and email.
  5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.

A notice that is missing these may not be valid. If it is close, we will ask you for what is missing.

What we do with a notice

  • We remove or disable the material promptly.
  • We tell the person who posted it, and send them a copy of your notice, including your name and contact details, so they can respond.
  • If the material was licensed to a buyer or shown by a partner, we tell them too.

If your content was removed: counter-notice

If you believe your content was removed by mistake or misidentification, send our agent a counter-notice with:

  1. Your physical or electronic signature.
  2. The material that was removed, and where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the US federal district court for the district where your address is (or, if you live outside the United States, any district where Mirai may be found), and that you will accept service of process from the person who sent the notice, or their agent.

We send a copy of your counter-notice to the person who sent the notice, and tell them we will restore the material in 10 business days. We restore it between 10 and 14 business days after we receive your counter-notice, unless our agent first hears that they have filed a court action to stop you.

False claims

Anyone who knowingly and materially misrepresents that material infringes, or that it was removed by mistake, may be liable for damages, including costs and lawyers' fees (17 U.S.C. §512(f)). Think about fair use and licences before you send a notice.

Repeat infringers

We close the accounts of repeat infringers (Terms §11.7).

  • A strike is a valid copyright notice against content you posted that was not withdrawn and that you did not successfully counter.
  • Three strikes in 12 months close your account. We may close an account sooner for clear, deliberate infringement.
  • A strike never falls on a person who only appears in someone else's content.
  • A closed account cannot be reopened, and its holder may not open another (Terms §2).
  • Earnings you have already earned are still paid under Terms Schedule C.
  • You can appeal a strike or a closure, free, within 6 months (Terms §11.6). A person decides.

Your content and Mirai's

Content made on Mirai may belong to Mirai (Terms §5). Either way, these rules apply to it. Do not upload or prompt for material you do not have the rights to use (Terms §5.5A, Community Standards A1(11)).
